QUA LA MANO
Nel patteggiamento ci si accorda per uno sconto di pena a fronte di una sentenza immediata. La critica comune è che in tal modo ce la si cava con poco. In effetti, uno pensa, l'imputato accetta solo quando gli conviene, l'istituto è ritagliato sulle sue esigenze. Dopodiché, parte la canonica indignazione giustizialista.
Mi sembra che le cose non stiano esattamente in questi termini, lo vedo nelle commissioni tributarie dove non accordarsi con l'Ufficio e intraprendere un contenzioso è diventato ormai un azzardo mortale. E, del resto, l'Ufficio non manca mai di ricordartelo con mille allusioni. In parole povere, l'imputato stava molto meglio prima, altro che "istituto ritagliato sulle sue esigenze".
La dinamica che ci sta sotto è piuttosto controintuitiva, provo a descriverla con un esempio. Considerate la situazione di un ipotetico PM che ha sulla scrivania cento casi all'anno con un budget di 100.000 euro da spendere. Cio' significa solo mille euro da spendere per indagare e perseguire ogni caso. Ebbene, se il PM riuscisse a spingere novanta imputati al patteggiamento, potrebbe poi concentrare tutte le sue risorse sui dieci che rifiutano, spendere diecimila euro per ogni caso e ottenere un tasso di condanne del 90 percento. Cio' significa che rifiuterà qualsiasi patteggiamento in cui la prospettiva di condanna sia per lui peggiore a quota 90%. Tutti gli imputati, del resto, starebbero molto meglio se nessuno di loro accettasse l'offerta di patteggiamento - che è poi la condizione precedente all'introduzione dell'istituto - ma poiché prima o poi la slavina partirà, l'istituto finirà per danneggiare le prospettive di quasi tutti gli imputati. Come tutte le leggi, anche il patteggiamento sembra fatto su misura per la burocrazia, che del resto questo leggi le scrive e le consegna nelle mani del politico utile idiota.

A firm such as an insurance company that routinely deals with a large number of customers offers a discount to anyone willing to sign over to it all tort claims he might have in the next year for less than a hundred dollars. An enterprising lawyer concludes that ten million people have gotten mildly sick due to something wrong with a brand of canned beans, giving each a legitimate claim for ten dollars in damages. The lawyer goes to the insurance company and offers to buy all of their claims for injury from canned beans. He makes the same offer to other firms that have similarly purchased their customers’ small claims. When he is done, he owns three million claims for ten dollars each. He goes to the bean company and offers to settle for eighty cents on the dollar, twenty-four million dollars. If they turn him down he sues– not on behalf of the victims, who have sold their claims to him via middlemen, but for himself. There is no need for an attorney to pretend to represent millions of people

Part of the problem with the modern system of plea bargaining is that a prosecutor can stack charges. Consider a defendant arguably guilty of an assault punished by a year in prison. A patto che...

Il patteggiamento è una procedura giudiziaria attraverso la quale l' imputato raggiunge un accordo con la controparte rendendosi disponibile a sopportare una pena più mite pur di non affrontare l' intero processo dove le eventuali pene saranno molto dure.

Chi patteggia non puo' dirsi colpevole per il semplice fatto che non si sottopone ad accertamenti puntuali.

Poiché nei processi si commettono molti errori, la giustizia umana è imperfetta, chi si sottopone a patteggiamento non è necessariamente colpevole. parlando in generale è piuttosto una persona riluttante a rischiare una pena elevata.

Da questo punto di vista sappiamo che l' avversione al rischio è tipica degli onesti mentre la propensione caratterizza i delinquenti.

Una persona onesta preferisce lavorare piuttosto che delinquere (e godersela a rischio di finire in cella). In altri termini, preferisce infliggersi una pena mite piuttosto che rischiarne una dura. ma è proprio questo lo scambio che propone il patteggiamento: pene miti e certe contro pene dure e incerte.
