Male e Bene sono indissolubilmente intrecciati, lo si sente dire spesso. Ma qui non intendo nel senso un po’ banale per cuiconvivono in ciascuno di noi.
Mi spiego allora meglio con qualche esempio.
Chi si batte più ardentemente per la giustizia fiscale? Certo, il moralista che ha nel mirino una società più giusta, ma anche l’ avido commercialista il quale sa bene che un fisco “più giusto” è anche un un fisco più complicato in grado di garantirgli profitti crescenti.
Chi si batte di più per un rigoroso riciclo dei rifiuti? Certo, chi vuole salvare il pianeta dal riscaldamento globale, ma anche la criminalità che specula grazie alle discariche abusive, che aumenterebbero così di valore.
Chi si batte di più per tassare i ricchi? Certo, chi anela ad una società più equa, ma anche chi offre servizi finanziari all’estero in grado di spostare capitali nei paradisi fiscali.
Chi favorisce i viaggi della speranza che portano verso l’Europa una massa di diseredati? Sì, certo, le infervorate prediche di Papa Francesco sul dovere dell’accoglienza, ma anche e soprattutto l’opera indefessa di scafisti trafficanti di uomini che, speculando su questo bisogno, ne garantiscono di fatto la realizzazione.
Chi si batte di più per imporre dazi alle merci straniere? Certo, chi ha a cuore la sorte dei lavoratori nazionali, ma anche i contrabbandieri che pensano al loro business..
Ammesso e non concesso che queste siano tutte lotte meritevoli capiamo bene come il contributo del “male” sia imprescindibile affinché il bene trionfi: nessuno come l’avido commercialista serve al meglio la causa per un fisco più giusto. Nessuno come il mafioso che gestisce una discarica abusiva favorisce la causa del riciclaggio. Nessuno come la finanziaria che esporta capitali all’estero spinge per un sistema fiscale più equo. Nessuno come i contrabbandieri è disposto a mettersi al servizio dei lavoratori nazionali.  E’ l’alleanza sottaciuta tra Papa Francesco e gli scafisti che io vedo come indissolubile intreccio tra bene e male.
I due poli sono contigui al punto di chiederci dov’è il vero bene è dov’è il vero male.
Se guardassimo solo alle “intenzioni” il problema non si porrebbe. Ma se invece guardiamo anche alle conseguenze, le cose si fanno assai più complicate.
In questo caso l’avido  commercialista, il mafioso, la finanziaria, il contrabbandiere e lo scafista non meriterebbero meno di quei santi che anelano ad una società più giusta, oppure a salvare il pianeta, o ancora a tutelare i nostri lavoratori.
E ricordiamoci sempre che il mondo in cui viviamo è costituito dalle conseguenze dei nostri comportamenti, mica dalle nostre intenzioni. Non si vede quindi perché il nostro apprezzamento debba limitarsi a queste ultime!

Ma c’è di più: nei nostri giudizi morali noi non solo discriminiamo in modo dubbio le conseguenze rispetto alle intenzioni ma, in modo ancora più dubbio, le conseguenze positive da quelle negative. In altri termini: siamo più pronti a percepire la malvagità di chi produce conseguenze negative che la santità di chi produce conseguenze positive.
Mi spiego meglio con un esempio.
Scena 1. Siamo nell’ufficio del boss, il suo consulente di fiducia prende la parola e dice: “capo, ho considerato nei dettagli il business che lei mi ha sottoposto, devo dire che promette di essere molto molto lucroso anche se l’impatto ambientale sarà inevitabilmente devastante”. Il capo reagisce alla sua maniera: “guardi, dell’ambiente non me ne frega un c***, procediamo immediatamente”.
Ebbene, che pensereste di un tipino del genere? Non dubito che la vostra condanna sarebbe inappellabile.
Scena 2. Siamo nell’ufficio del boss, il suo consulente di fiducia prende la parola per dire: ” capo, ho considerato nei dettagli il business che lei mi ha sottoposto, devo dire che promette di essere parecchio lucroso, oltretutto avrà un impatto ambientale benefico.” Il capo risponde pronto: ” guardi, dell’ambiente me ne fotto, procediamo all’istante”.
Ebbene, che pensereste di un tipo del genere? Non penso proprio che siate disposti a farne un benefattore dell’umanità.
Eppure dovresti farlo se solo vi attenete ai criteri guida del primo giudizio.
La seconda scena, in effetti, è perfettamente simmetrica alla prima e richiede quindi un giudizio simmetrico.
Se nella prima scena chi commette un male “collaterale” viene condannato senza appello, chi nella seconda scena commette un bene “collaterale” dovrebbe essere esaltato.
Perché invece una simile asimmetria di giudizio?
Evidentemente, non tutte le conseguenze sono uguali. Siamo molto più pronti a giudicare male osservando conseguenze negative che a giudicare bene osservando conseguenze positive. E questo senza giustificazione.
In sintesi, noi tendiamo istintivamente a privilegiare le intenzioni rispetto alle conseguenze. D’altro canto, quando riusciamo a considerare le conseguenze non intenzionali, solo quelle negative ci sollecitano un giudizio etico.
Tutto ciò crea un problema poiché il nostro sistema di convivenza, ovvero  la società capitalistica, si fonda essenzialmente sulla produzione di bene “collaterale” – chi offre si mette al servizio di chi chiede con l’unico scopo di ricavarne un profitto- cosicché la sua portata etica non viene colta dal nostro istinto che persiste nelle sue condanne scordandosi ogni apprezzamento anche di fronte ad esiti indubbiamente positivi.
A questo punto, come mettere a frutto queste considerazioni? Beh, il miglior modo per fare il primo passo consiste per l’appunto nel riconoscere – ma nel riconoscere sul serio – che male e bene sono inestricabilmente intrecciati.

Il bene dove non te l'aspetti

Dolo e colpa sembrano all’origine degli atti che condanniamo.
Senza dolo o colpa è difficile emettere una sentenza di condanna morale.
L’atto criminale non merita assoluzione, ma nemmeno un comportamento colpevole puo’ essere perdonato.
La considerazione è importante perché è grave ma la colpa molto più diffusa.
Se Mister Y guida ubriaco e investe un bimbo sulle strisce si macchia di una grave colpa.
D’accordo, non voleva uccidere, nel momento in cui guidava non era consapevole, se ci limitassimo a quel lasso di tempo lui sarebbe innocente: non c’è né colpa né dolo nell’incidente che procura.
In effetti, se qualcuno viene drogato da terzi con la forza non puo’ certo essere ritenuto eticamente responsabile di quel che combina dopo.
Mister Y è “colpevole” perché “avrebbe potuto” conoscere i rischi. Riteniamo la sua negligenza una forma larvata di intenzione.

Fin qui tutto liscio, ma ecco che cominciano i problemi.
Facciamo il punto: un tribunale morale chiamato a condannare, condanna solo per dolo e per colpa. La presenza di un’intenzione nell’imputato – chiara o larvata - sembra fare la differenza.
Pensiamo ora ad un tribunale chiamato a premiare. Sembrerebbe che basti agire in modo simmetrico all’altro tribunale.
Il dolo ha una facile corrispondenza: al criminale si contrappone il giusto. A Hitler si contrappone San Francesco.
Ma qual è il contraltare del “colpevole”? Qual è il contraltare di Mister Y?
Chiamiamolo Mister X.
Alla nostra intuizione immediata un simile personaggio sfugge, tanto è vero che non abbiamo una parola per identificarlo con chiarezza.
Il colpevole (Mister Y) trascura un male eventuale che poi si realizza, per questo lo condanniamo.
Mister X dovrebbe essere un tale che trascura un bene eventuale che poi si realizza, per questo dovremmo ammirarlo!
Esiste una persona del genere?
Si propone spesso l’esempio del manager avido: viene proposto a costui un business plan che realizza alti profitti ma che come effetto collaterale deteriora l’ambiente. Lui reagisce così: “dell’ambiente me ne frego, mi interessano solo i profitti, procediamo”. E noi – naturalmente – condanniamo un simile figuro.
In una variante della storiella al manager viene proposto un piano che realizza alti profitti e in più, come effetto collaterale, migliora l’ambiente. Lui reagisce così: “dell’ambiente me ne frego, mi interessano solo i profitti, procediamo”. Ora che facciamo? Ci profondiamo in elogi così come prima abbiamo condannato con sprezzo? Se seguissimo la logica del giudizio precedente dovremmo farlo, siamo in una situazione perfettamente simmetrica.
Cio’ che ci rende difficile elogiare il manager avido è cio’ che ci rende difficile intuire l’esistenza di Mister X, anche se realizziamo in modo chiarissimo l’esistenza del suo contraltare, Mister Y.
Cerchiamo ora di correggere il nostro bias cognitivo: Mr Y trascura un male eventuale che poi si realizza, noi lo condanniamo moralmente. Mr X trascura un bene eventuale che poi si realizza, noi dobbiamo elogiare moralmente il suo comportamento.

Vediamo ora le conseguenze teologiche che derivano dall’eliminazione del bias cognitivo di cui sopra.
Padre Tosato dice che il messaggio evangelico puo’ convivere con la logica del capitalismo solo se siamo disposti ad accettare come meritorio un bene prodotto con senza intenzionalità.
A prima vista la cosa sembra impossibile.
Ma noi già accettiamo come perfettamente naturale  la situazione simmetrica, ovvero deprechiamo un male prodotto senza intenzionalità: quello dell’ubriaco che investe il bambino.
L’imprenditore (Mister X) potrebbe essere il contraltare dell’ubriaco (Mister Y): pensa solo al suo profitto ma crea ricchezza per tutti. Non pensa direttamente al bene che fa ma lo realizza in concreto.
L’ubriaco (Mister Y) pensa solo al suo piacere ma porterà la morte in strada. Non pensa direttamente al male che fa ma lo realizza concretamente.
Così come Mister Y è condannabile e merita l’ Inferno, Mister X è ammirabile e merita il Paradiso.
Mister Y avrebbe potuto pensare al possibile male e frenarsi. Non lo ha fatto. Merita una condanna all’ Inferno.
Mister X avrebbe potuto pensare al possibile bene e frenarsi. Non lo ha fatto. Merita un assunzione in Paradiso.
Il tutto contro la nostra distorta intuizione ma conformemente alla nostra ragione.

The Concept of Intentional Action A Case Study in the Uses of Folk Psychology - Experimental Philosophy by Joshua Knobe and Shaun Nichols

A question now arises about the relationship between folk psychology and scientific psychology. To what extent are they similar, and to what extent different?

This one change in the vignette leads to a quite radical change in people’s intuitions. Faced with this second version, most people say that the chairman did not intentionally help the environment.

The results were clear and compelling: 82 percent of subjects who received the story about environmental harm said that the chairman harmed the environment intentionally, whereas only 23 percent of subjects who received the story about environmental help said that the chairman helped the environment intentionally.

The effect continues to emerge when the whole experiment is translated into Hindi and run with Indian subjects (Knobe and Burra 2006); it emerges when subjects are only four years old (Leslie et al. 2006); it emerges even when the experiment is run on subjects who suffer deficits in emotional processing due to lesions in the ventromedial prefrontal cortex (Young et al. 2006).

How then are we to make sense of the fact that moral considerations sometimes influence people’s application of the concept of intentional action?

I want to suggest is that there is another use of the concept of intentional action in light of which the influence of moral considerations really does make sense. The claim is that people’s concept of intentional action should not be understood simply as a tool for predicting and explaining behavior.

First, let us consider the debate surrounding the role of trying and foresight. Some philosophers think that trying is a necessary condition for intentional action (Adams 1986; McCann 1986); others argue that a certain kind of foresight can actually be sufficient even in the absence of trying (Ginet 1990). The distinction between these two views comes out most clearly in cases of what might be called side effects. An outcome can be considered a ‘side effect’ when (1) the agent was not specifically trying to bring it about but (2) the agent chose to do something that she foresaw would involve bringing it about. The question is: Will people think that the agent brought about such an outcome intentionally?

Consider a case in which an agent is trying to perform a behavior and actually does succeed in performing that behavior. Has the agent performed the behavior intentionally? According to some philosophical analyses, the answer is yes (e.g., Brand 1984); according to others, the answer is no (e.g., Mele and Moser 1994).

He knows that he will inherit a lot of money when his aunt dies. One day, he sees his aunt walking by the window. He raises his rifle, gets her in the sights, and presses the trigger. But Jake isn’t very good at using his rifle. His hand slips on the barrel of the gun, and the shot goes wild . . . Nonetheless, the bullet hits her directly in the heart. She dies instantly. Changing the moral significance of the behavior in this way leads to a quite substantial change in the pattern of people’s intuitions. Faced with this second vignette, people overwhelmingly say that Jake hit his aunt intentionally.

Klaus is a soldier in the German army during World War II. His regiment has been sent on a mission that he believes to be deeply immoral. One day, it occurs to him that the best way to sabotage the mission would be to shoot a bullet into his own regiment’s communication device. He knows that if he gets caught shooting the device, he may be imprisoned, tortured, or even killed. He could try to pretend that he was simply making a mistake—that he just got confused and thought the device belonged to the enemy—but he is almost certain that no one will believe him. With that thought in mind, he raises his rifle, gets the device in his sights, and presses the trigger. But Klaus isn’t very good at using his rifle. His hand slips on the barrel of the gun, and the shot goes wild . . . Nonetheless, the bullet lands directly in the communications device. The mission is foiled, and many innocent lives are saved. Here most people feel that Klaus did hit the communications device intentionally.

I tried to create a situation in which people would come to believe that a behavior can be blameworthy even if it is not intentional. Subjects were given a story about an agent who performed a behavior unintentionally but seemed clearly to be deserving of blame. (The story concerned an agent who harms other people while driving drunk.) Subjects were then asked (a) whether or not the agent acted intentionally and (b) whether or not the agent was to blame for his behavior. As expected, almost all subjects answered no to the first question and yes to the second. Immediately after answering this question, subjects were presented with a case in which moral considerations usually have an impact on people’s intentional action intuitions… The answer is that the moral status of the behavior continues to have an impact even in this situation. As in previous studies, subjects were far more likely to classify the behavior as intentional when it was morally bad….

People’s intentional action intuitions seem to exhibit a certain flexibility, such that they look for different features when confronted with different behaviors, and they tend to consider in each case the specific features that would be relevant to determining whether the agent is deserving of praise or blame.

Experimental Philosophy by Joshua Knobe, Shaun Nichols - L'intenzione


  1.  Tesi: la morale ci chiede di rilevare la presenza di un' intenzione prima di condannare. Ma a volte il nesso agisce a ritroso: presupponiamo intenzione laddove condanniamo... 
  2. Knobe effect: ti propongono un'azione da cui scaturisce un bene xsonale e un male collettivo. Rispondi di procedere del male collettivo non ti interessa. Poi ti propongono un'azione che implica sia un bene xsonale che collettivo. Rispondi che del bene collettivo te ne sbatti, si proceda. Ebbene, la cavia media ririene che tu nei cfr della collettività abbia agito "intenzionalmente" solo nel primo caso... 
  3. Cosa occorre x dire che Tizio ha voluto X. Il caso dell'effetto collaterale non voluto ma prevedibile. È intenzionale? Il Knobe effect è rilevante: la risposta dipende dal giudizio morale che si dà dell'effetto collaterale... 
  4. Anche l'abilità interagisce in modo singolare con moralità e intenzionalità. Jack vuole fare centro con lapistola ma è un inetto, spara e fa centro per puro caso. Il suo centro è intenzionale? Il giudizio cambia se l'azione portata a termine da Jack fosse malvagia o benigna. Mele: la gente pensa che un colpevole agisca sempre intenzionalmente. Sbagliato: vedi caso dell' ubriaco. Adams: la gente è pragmatica e bada alle conseguenze di quanto dice piuttosto che alla precisione. Nadelhoffer: semplici bias dovuti all' indignazione Io: distinguere colpa da dolo, l' intenzione gioca ruoli diversi. Nel 1 caso riteniamo int. irrilevante in assenza di conseguenze etiche o cattive. Azzardo un' ipotesi per uscire dal ginepraio: sbagliamo nel contrapporre merito e colpa, la vera simmetria è tra merito e dolo. La colpa implica un' intenzionalità indiretta. Problema: qual è il concetto positivo simmetrico a quello di colpa? Boh, forse non l' abbiamo e questo scatena i paradossi e i bias

Perché non sono compatibilista. Qui di seguito i migliori argomenti per il compatibilismo
  1. Incompatibilismo: libero arbitrio e determinismo sono incompatibili... 
  2. La posizione i. viene con l'argomento che è più intuitiva. Ma è proprio così?... 
  3. Primo problema: di quale libertà parliamo? Secondo gli autori di quella che consente di attribuire meriti e colpe. La libertà che ci interessa è legata alla dignità della persona. IMHO: qui c'è una forzatura, il legame tra libertà, meriti, giustizia e dignità è complicato. Perchè mai introdurlo quando disponiamo di nozioni più elementari del concetto di libertà: libero è colui che può scegliere tra due alternative senza essere determinato verso una delle due opzioni... 
  4. Perchè è così importante sapere se i. corrisponde all'intuizione comune? p.1819... 
  5. Come testare l'intuizione. Esperimenti p.1908... 
  6. L'i. tipo fa osservare che non appena ci viene fatto sapere che un certo comportamento è dettato da cause esterne noi allentiamo la responsabilità. È quindi tenendo conto di qs che si organizzano gli esperimenti..
  7. Immaginiamo qs. scenario: abbiamo scoperto tutte le leggi di natura e possiamo prevedere tutto con certezza. Prevediamo anche che Hal rapinerà la Banca e come tutte le ns. previsioni la cosa si avvera. Hal è responsabile? Molti rispondono sì. Secondo esempio: immagina che l'univrrso venga creato più volte sempre destinato a subire la medesima evoluzione. In tutti qs. universi Hal compie il suo furto. Hal è colpevole? Molti rispondono sì. 
  8. Critica: 1) prevedere e determinare sono cose ben diverse, tutti i giorni compiamo azioni libere (nel senso i. del termine) ma xfettamente prevedibile. 2) la scienza può ipotizzare e corroborare l'ipotesi determinista ma nn può "scoprirlo" una volta x tutte visto che segue una logica induttiva; la situazione che ci viene chiesta di immaginare è quindi inimmaginabile 3) per 1 e 2 ciò che intuiamo veramente è che il determinismo è sempre confutabile qui ed ora: se il superpc mi dice che ora alzerò il braccio a me basterà abbassarli x confutarlo 4) esistono esperimenti alternativi. Certo, ma nn ha molto senso realizzarli: metti la cavia di fronte ad un bivio con una strada sbarrata, quando imboccherà l'altra chiediti se lo ha fatto liberamente?... 
  9. Gli autori riconoscono che + il detrminismo è sullo sfondo più i risultati sono confermati ma aggiungono che il determinismo è per sua natura sullo sfondo e nn va confuso con altre cause che comprimono la libertà. IMHO: qs argomento non si capisce: xchè mai non dovrebbe essere un mondo determinato quello dove dio vede e dispone tutto? Dire che in quel caso non introduciamo il determinismo ma un'altra causa che comprime la libertà non è comprensibile poiché allo stesso modo potremmo dire che nel caso presentato non si testa il determinismo come limite alla libertà ma le leggi naturali. 
  10. Alcuni sostengono che la nozione intuitiva di libertà che abbiamo è libertaria (possibilità di fare altrimenti) e che l'i. è derivato, un mero calcolo che a volte puo' essere complicato. Negli esperimenti fatti i soggetti falliscono nella derivazione nn nell'intuizione. Risposta degli autori: si tratta di considerazioni derivate dall'introspezione e nn da esperimenti condotti da nn filosofi.
  11. Inwagen: le intuizioni che contano sono più basilari. Del tipo che se C dipende solo da A e B e noi non possiamo incidere su A e B allora nn possiamo incidere nemmeno su C (prop. transitoria). Negli scenari presentati le cavie nn riconoscono un caso in cui le intuizioni di base sono applicabili (noi filosofi invece sì) ciò nn toglie che tali intuizioni esistano, anzi questa ipotesi è rafforzata dal fatto che quanto più lo scenario scopre un meccanismo transitorio tanto più i giudizi delle cavie si allineano con la soluzione i. Gli autori sostengono che il loro esperimento è comunque un indizio di non esistenza della prop. transitiva ma trascurano l'esistenza di un ragionamento complesso e quindi la necessità di esperimenti graduali che introducano in modo sempre più scoperto il determinismo... 
  12. Altri ammettono l'esistenza di intuizioni confliggenti tra cui scegliere: quella dello scenario e quella della prop. transitiva. Qs. anarchia delle intuizioni ci porta a negare che il concetto di free will abbia senso. Ma i. sceglie un'altra via: l'intuizione della prop.trans. è più basica mentre quella sperimentata è in realtà la soluzione ad un calcolo complesso. IMHO: mi sembra di poter concludere affermando che negli scenari proposti la cavia nn ricostruisce correttamente il dilemma filosofico poichè diverse intuizioni e istinti si mescolano visto la complessità. Tutravia le intuizioni oggetto delli studio sembrano ugualmente esistere poichè la ricostruzione della cavia è sempre più coerente con esse quanto più le leggi detrministiche sono evidenti.
  13. Gli autori sembrano problematizzare una gerarchia tra intuizioni: dalle più semplici alle più complesse. Un criterio potrebbe essere l'universalità: se una intuizione è universale allora è semplice. DaL che deriva che le intuizioni astratte sono più semplici di quelle complesse e quindi che l'intuizione della prop. transitiva è più semplice dell'intuizione richieste dagli sperimentatori.
